Please read through the terms and conditions thoroughly before enrolling. When enrolling as a member of Indigo Soul Wellness, you agree to the terms and conditions as laid out on this website (www.indigosoulwellness.com).

General Terms & Conditions

BOOKING OF CLASSES

  • Bookings can be made using the MindBody system via the Indigo Soul Wellness App or website.

  • Payment must be made at the time of booking, there are no exceptions. An active pass, membership or payment at check out is required. 

  • Owners and/or Instructors reserve the right to restrict clients to a particular class type for safety reasons; and Owners and/or Instructors reserve the right to turn clients away if they do not have the correct medical clearance.

  • We welcome children over the age of 16 to attend class without a parent or guardian present.

  • Parental/ guardian consent must be emailed to our office for those that are 16 or 17 years of age.

INTRO PASSES

  • Both Intro Passes (Reformer Pilates Intro Pass and YMB Intro Pass, valid for 14 days) are only available to brand new clients. 

  • You can only purchase the introductory offer once per studio. 

  • The introductory offer is non-refundable nor transferable and will activate from the date of your first class booking and be valid for 14 days from the date of purchase. 

  • If you have purchased the Introductory Offer more than once, you agree to be charged for each class attended at the casual rate.

  • Cancellation policies apply to all Intro Pass holders.

WAITLISTS

  • If a class is currently fully booked, it will be ‘waitlisted’. If you have placed yourself on a waitlist for a class and a place becomes available, then you will be booked into the class and receive an email / text from us (depending on your subscribed preferences) confirming that you have been moved from the waitlist to the class. 

  • You accept responsibility to ensure your schedule notifications are switched on when placing yourself on a waitlist.

  • Waitlists close 2 hours prior to the class starting. Once a spot becomes available you are automatically placed into the class. 

  • If you do not attend or need to cancel within 4 hours of the class starting (or no show), the late cancel policy will apply. If you remove yourself from the waitlist outside the cancellation no forfeit or fee will apply.

  • If you become unable to attend a class for which you are on the waitlist, it is your responsibility to remove yourself from the waitlist.

PAYMENTS/AUTOPAY FAIL

  • To hold a membership or active pass with Indigo Soul, you must always have a linked credit card on your account. 

  • The weekly payment for your membership will be automatically charged from your linked credit card each week on your chosen day. If the payment is declined, it will automatically be attempted the following day and if declined again, a default fee of $14 will be charged.

  • If the payment is two weeks overdue, your membership may be terminated and all scheduled classes cancelled with prior missed payments still payable and you agree that a collections agency will be engaged should you not pay your membership fees in full.

  • Memberships and other pricing options may be subject to price increases. Any changes will be provided to members no less than 4 weeks in advance.

PREGNANCIES, POST-NATAL & INJURIES

  • Prenatal clients are welcome to attendant Indigo Soul.

  • Clients must inform instructors of pregnancy or injuries before attending any classes.

  • By joining classes at Indigo Soul, prenatal clients acknowledge and accept inherent risks. 

  • Clients release Indigo Soul, its instructors, and staff from liability for injuries or complications during participation.

  • Open communication with instructors about pregnancy status and health concerns is recommended. 

  • Your pregnancy status will be recorded on your Mindbody account and will be visible to instructors prior to the class starting.

  • Prior to class participation, prenatal clients must obtain medical clearance from their healthcare provider to ensure Yoga and Pilates is safe for their circumstances.

  • Extended suspension for pregnancy is possible with a medical certificate.

  • Termination terms apply, and no holds are permitted during the notice period.

  • If you are injured, you can suspend your membership for the lesser of the duration of your injury and 6 months. 

    • If you are on a class pack, you can extend the expiry of your class pack for the lesser duration of your injury and 3 months. 

    • A medical certificate must be forwarded to our office and extensions due to medical reasons must be requested before the expiry date of the class pack.

GIFT CARDS

  • Gift Cards are non-refundable and valid for 3 years from the date of purchase.

  • To be used on Indigo Soul products and services only and are not redeemable for cash.

CLASS & INFRARED SAUNA PACKS

  • 20 Class Packs are valid for 4 months from purchase date. 

  • 10 Class Packs are valid for 3 months from the date of purchase.

  • 5 Infrared Sauna Packs are valid for 3 months from the date of purchase.

  • 10 Infrared Sauna Packs are valid for 6 months from the date of purchase.

  • 20 Infrared Sauna Packs are valid for 9 months from the date of purchase.

  • Sessions are non-refundable, are not transferable and can be extended if you are injured or ill, in which case we will request a medical certificate. 

  • Packs are for individual use only and cannot be shared.

  • Extensions due to medical reasons must be requested before the expiry date.

  • Packs are redeemable at their studio of relevance only.

Cancellation Policy

Indigo Soul reserves the right to cancel classes with minimum numbers booked in. You will be contacted via text 2 hours prior to the start of class should it need to be cancelled and your session returned.

CLASS CANCELLATIONS

  • Cancellations/ rescheduling classes need to be made more than 4 hours prior to the commencement of the class

  • No exceptions will be made to this policy to ensure fairness and consistency to all members.

  • We do not accept cancellations via text, phone, social media or email.

  • Late cancellations made less than 4 hours before class will forfeit the class. 

  • No shows and absences will forfeit the class.

  • Being late is considered a No Show as is a Late Cancel 30 minutes before class. 

  • This cancellation window applies to all Intro Passes.

UNLIMITED MEMBERS – Yoga, Mat & Barre Pilates Classes

  • No shows will incur a $10 fee

  • Late cancels will incur a $5

  • Fees will be charged to the card on file approximately 48 hours after the class.

  • If the fee is unable to be charged on two occasions your account will appear with a balance owing - all accounts with balances owing will be suspended from booking until the balance has been paid.

UNLIMITED MEMBERS – Reformer Pilates Classes

  • No shows will incur a $15 fee

  • Late cancels will incur a $10

  • Indi Members will get one fee waived per calendar month.

  • Fees will be charged to the card on file approximately 48 hours after the class.

  • If the fee is unable to be charged on two occasions your account will appear with a balance owing - all accounts with balances owing will be suspended from booking until the balance has been paid.

APPOINTMENT CANCELLATIONS

  • We have a 24 hour cancellation window on all massage and infrared sauna appointments. 

  • We do not accept cancellations via text, phone, social media or email.

  • Cancellations made more than 24 hours before appointment will not incur a fee.

  • Late cancellations made less than 24 hours before class will incur the following fees:

    • Infrared Sauna - $15 fee

    • Massage - 50% of the price of the service booked. 

  • No shows and absences will incur the following fees:

    • Infrared Sauna - $30 fee

    • Massage - full fee equivalent to the total cost of the service booked.

  • If you are late your session will not be extended past the original scheduled finish time. 

  • This cancellation window applies to all Infrared Sauna pass holders including Intro Passes.

Membership Terms & Conditions

UPGRADE/DOWNGRADE OPTIONS

  • Upgrades may be processed as of the next scheduled direct debit. Any discounted rates currently locked in will be honoured for upgrades.

  • The minimum 4-month term will reset, starting at the agreed date the upgrade is processed.

  • Downgrades may be processed once the minimum term is met. Any currently locked in membership discounts will be lost once a downgrade is applied.

  • The minimum 4-month term will reset, starting at the agreed date the downgrade will commence.

WEEKLY/FORTNIGHTLY MEMBERSHIPS

Includes:

  • Deluxe Membership

  • Combo Membership

  • Unlimited Reformer Pilates Membership

  • Unlimited YMB Membership

  • 2 /week Memberships

  • Memberships renew every 7 or 14 days and have a minimum term of 4 months (16 weeks). 

  • Once the minimum term is met, you will continue to be charged the weekly membership fee unless you notify us that you would like to cancel by providing 7 days written notice by filling out our cancellation form. 

  • Any monies currently outstanding must be finalised prior to placing your termination notice. 

  • A hold cannot be placed during the notice period of 7 days.

  • Memberships can be put on hold (or suspended) for up to 4 weeks (28 days) per calendar year. 

  • 5 days’ notice must be given by submitting the hold dates to our office via the Pause/ Cancel Form. 

  • The hold must be in 7-day increments, starting from your direct debit day. 

  • When placing a suspension on the membership, this extends the minimum term end date by the number of weeks you have suspended the membership for. 

  • Any monies currently outstanding must be finalised prior to placing a hold to your membership. 

  • We strictly do not back-date any membership holds. If you are injured, you can suspend your Membership for the lesser of the duration of your injury and 6 months with a medical certificate forwarded to our office.

  • Memberships can be placed on hold in excess of the standard 4 week pause/hold for $10 per week for any YMB memberships and $20 per week for any Reformer Pilates memberships - up to 12 weeks per year.

  • For those on a 2 class per week Membership, any classes you book over your membership limit you agree to be charged an ‘Extra Class Fee’ in the amount of $15 per extra class that you book or attend. 

  • If you do not book or attend your maximum limit of memberships classes during the allocated week, any unused classes will not rollover.

  • Memberships are non-transferrable between individuals.

  • Indigo Soul may terminate a membership without notice for inappropriate, offensive or illegal behaviour, as determined by us, which occurs on our premises or is directed at our staff or other members.

  • 6 Month Upfront Membership

  • 12 Month Upfront Membership

  • Upfront memberships are non transferable or refundable.

  • In the instance of long term or permanent injury or illness that prevents the use of our services, a membership refund will be permitted. Termination will take effect from the date we receive written confirmation from a medical doctor.

  • Memberships can be put on hold (or suspended) for up to 4 weeks (28 days) per calendar year for 12 month Upfront Memberships and 2 weeks for 6 month Upfront Memberships. This will extend the expiry date of the upfront membership.

  • 5 days’ notice must be given by submitting the hold dates to our office via the Pause/ Cancel Form.

Limitation of liability and indemnity
& Privacy Policy

Upon booking into an Indigo Soul class, or entering the studio, you agree to the following:

  • Whilst all care is taken, activities at Indigo Soul are not without risk which you accept by undertaking those activities.

  • You agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Indigo Soul or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

  • To the fullest extent permitted by law, Indigo Soul, it’s officers, employees, contractors, instructors, agents and nominees (together the “Indemnified Parties”) will not be liable and exclude any and all liability to you arising under or in connection with these terms and conditions, or otherwise undertaking any activities at Indigo Soul.

  • You further agree to fully indemnify the Indemnified Parties against all liabilities, loses, damages and costs suffered or incurred by the Indemnified Parties arising from or in connection with you breaching these terms and conditions, or otherwise undertaking any activities at Indigo Soul.

  • You agree that Indigo Soul is not responsible in the event of loss, damage, unauthorised use, theft, or injury resulting from and to any personal property that you bring onto, or undertake on, the premises of Indigo Soul.

  • You acknowledge and agree that Indigo Soul’s liability to you in connection with these terms and conditions, and the undertaking of activities at Indigo Soul, in the aggregate is limited to the refund of the fees paid for the Indigo Soul activity, and in the case of Weekly Memberships, the fees paid for the first 4 months of the Weekly Membership.

  • You further acknowledge and agree that by booking into a class or otherwise attending Indigo Soul, you agree to the above terms and conditions and waive certain legal rights, including the right to sue in the circumstances set out above.

These Terms and Conditions are governed by the laws of the State of Queensland, Australia, and the parties irrevocably submit to the exclusive jurisdiction of the courts having jurisdiction in the State of Queensland, Australia, and the courts of appeal from them.

Indigo Soul retains the right to update or modify these terms and conditions. Clients will be notified of any changes where possible.
